These Terms of Service (“Terms”) govern your access to and use of this website, including any property search tools, listing information, IDX content, forms, communications, accounts, and other services made available through the website (collectively, the “Site”).
By accessing or using the Site, you agree to these Terms. If you do not agree with these Terms, please do not use the Site

The Site is provided for general informational and real estate search purposes. Nothing on the Site creates an agency, brokerage, fiduciary, or other professional relationship between you and Bowman Real Estate Group unless and until such relationship is established pursuant to applicable law and a separate written agreement, where required.The Site does not constitute an offer to buy, sell, lease, or otherwise transact in real property.
2. MLS and IDX Information
Certain property information displayed on the Site may be supplied through one or more Multiple Listing Services (“MLS”) and may be made available through an Internet Data Exchange (“IDX”) service.
MLS and IDX information is provided for consumers' personal, non-commercial use and may be used solely to identify prospective properties that consumers may be interested in purchasing, selling, or otherwise evaluating, to the extent permitted by applicable MLS rules.
You may not:
Copy, scrape, reproduce, redistribute, republish, retransmit, or commercially exploit MLS or IDX information;
Create or maintain a database, compilation, mailing list, or other collection of MLS or IDX information;
Use MLS or IDX information to develop, train, or operate a competing real estate database, listing service, valuation product, or similar service;
Use automated means, including bots, crawlers, spiders, scripts, or scraping technologies, to collect MLS or IDX information;
Make any portion of the MLS database or IDX feed available to another person or entity; or
Use MLS or IDX information for any purpose prohibited by applicable MLS rules, licensing laws, or other applicable law.
These restrictions are intended to protect the rights of the MLS, listing brokers, listing agents, sellers, and other parties whose information may appear on the Site.
3. Accuracy of Property Information
Property information, including listing descriptions, photographs, prices, property characteristics, square footage, availability, status, and other information, may be obtained from MLS databases and/or other third-party sources.
Information is deemed reliable but is not guaranteed accurate.
Property information may change without notice and may contain errors, omissions, or inaccuracies. Properties may be listed, withdrawn, sold, leased, or otherwise become unavailable without notice.
You should independently verify all information that is important to you, including but not limited to:
Property availability and status;
Price and terms;
Property dimensions and square footage;
Lot size;
Property taxes;
School information;
Zoning and permitted uses;
HOA or condominium information;
Features and improvements;
Utility information;
Property condition; and
Any other material fact concerning a property.Neither Bowman Real Estate Group nor its agents should be relied upon as the sole source for verification of property information.
4. MLS Sources and Listing Attribution
Where required by applicable MLS rules, listing information displayed through the Site will identify the applicable MLS, listing brokerage, listing agent, and/or other required source information.
The applicable MLS and its participants, subscribers, brokers, agents, and licensors may retain rights in listing information and content displayed through the Site.
MLS and IDX displays may also be subject to additional terms, notices, disclaimers, and attribution requirements established by the applicable MLS.
5. No Guarantee of Availability
A property appearing on the Site does not guarantee that the property remains available.
A listing may become unavailable, pending, under contract, sold, leased, withdrawn, expired, or otherwise changed before the Site is updated.
Although Bowman Real Estate Group and its technology providers may receive periodic updates from MLS sources, we do not guarantee that the Site reflects the most current status of every property at the precise time you view it.
6. No Legal, Tax, Financial, Inspection, or Other Professional Advice
Information provided through the Site is for general informational purposes only.
Nothing on the Site constitutes legal, tax, accounting, financial, lending, insurance, appraisal, inspection, engineering, environmental, architectural, construction, or other professional advice.
You should consult appropriately qualified professionals before making decisions concerning a property or real estate transaction.
7. Fair Housing and Non-Discrimination
Bowman Real Estate Group supports equal access to housing and complies with applicable federal, state, and local fair housing and anti-discrimination laws.
The Site and its property search functionality are not intended to discriminate against any person based on a protected characteristic under applicable law.
Property descriptions, photographs, neighborhood information, school information, demographic information, and other third-party content may originate from sources outside Bowman Real Estate Group's control. Such content should not be interpreted as an indication that any property is available or unavailable to a particular person or class of persons based on a protected characteristic.
8. User Accounts and Saved Searches
Certain features of the Site may allow you to create an account, save properties, establish searches, receive alerts, or submit inquiries.
You agree to provide accurate and current information when creating an account or submitting information through the Site.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
Bowman Real Estate Group reserves the right to suspend or terminate accounts that are used in violation of these Terms or applicable law.
9. Communications and Property Inquiries
By submitting your contact information through the Site, including through a property inquiry, registration form, contact form, request for information, or similar feature, you authorize Bowman Real Estate Group and its representatives to contact you regarding your inquiry and real estate-related services, subject to applicable law and your communication preferences.
Where applicable, marketing communications may be subject to separate consent requirements. You may opt out of marketing communications by following the unsubscribe instructions provided in the communication or by contacting us.
Consent to receive marketing communications is not required as a condition of purchasing or selling property.
10. Third-Party Services and Websites
The Site may contain links, integrations, advertisements, mapping services, mortgage tools, property information, social media features, or other services provided by third parties.
Bowman Real Estate Group does not control and is not responsible for third-party websites, services, content, policies, availability, or accuracy.
Your use of third-party services may be subject to those third parties' own terms and privacy policies.
11. Intellectual Property
Except for MLS content and other third-party materials, the Site and its original content, including text, graphics, logos, photographs, design elements, software, trademarks, service marks, and other materials, are owned by or licensed to Bowman Real Estate Group and are protected by applicable intellectual-property laws.You may access and use the Site for its intended personal and lawful purposes.
You may not reproduce, distribute, modify, publish, transmit, sell, license, create derivative works from, or commercially exploit Site content without prior written permission, except as expressly permitted by law.
Nothing in these Terms transfers any ownership interest in MLS data, listing content, photographs, trademarks, or other third-party materials to you.
12. Listing Content and Third-Party Rights
Listing photographs, descriptions, videos, virtual tours, floor plans, trademarks, logos, and other materials may be owned by or licensed to listing brokers, agents, sellers, photographers, MLSs, or other third parties.
You may not copy, download, reproduce, modify, distribute, or commercially use such materials except as expressly permitted by applicable law and the rights holder.
13. Prohibited Conduct
You agree not to use the Site to:
Violate any applicable federal, state, or local law or regulation;
Violate MLS rules or IDX requirements;
Scrape, harvest, crawl, download, or systematically collect Site or MLS data;
Interfere with the operation or security of the Site;
Introduce malicious code, viruses, or other harmful technology;
Attempt to gain unauthorized access to accounts, systems, databases, or networks;
Impersonate another person or entity;
Submit false, misleading, fraudulent, or deceptive information;
Use the Site for unauthorized commercial solicitation;
Circumvent access controls or technological restrictions;
Infringe intellectual-property, privacy, publicity, or other rights; or
Use Site information for any purpose prohibited by applicable MLS rules.
14. Automated Access and Scraping
Because MLS and listing information may be subject to contractual, licensing, copyright, and database restrictions, automated collection or extraction of Site or MLS information is prohibited unless expressly authorized in writing by Bowman Real Estate Group and permitted by the applicable MLS.
This prohibition includes data scraping, bulk downloading, automated querying, crawling, extraction, mirroring, framing, or systematic collection.
15. Privacy
Your use of the Site is also subject to our Privacy Policy, which explains how Bowman Real Estate Group collects, uses, stores, and discloses personal information.

18. Limitation of Liability
To the maximum extent permitted by applicable law, Bowman Real Estate Group, Vanguard Properties, its affiliated agents, employees, contractors, technology providers, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of, or inability to use, the Site.
This includes, without limitation, losses arising from reliance on property information, listing changes, listing inaccuracies, website interruptions, third-party services, or communications submitted through the Site.
Nothing in these Terms limits liability that cannot lawfully be limited or excluded.
19. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Bowman Real Estate Group, Vanguard Properties, its affiliated agents, employees, contractors, licensors, service providers, and applicable MLSs from claims, damages, liabilities, costs, and expenses arising from your unlawful use of the Site, violation of these Terms, violation of MLS or IDX restrictions, or infringement of another party's rights.
20. Changes to the Site
Bowman Real Estate Group may modify, suspend, discontinue, or restrict any portion of the Site at any time.
We may also modify listing-search functionality, property information, features, services, or integrations without notice.
21. Changes to These Terms
We may update these Terms from time to time.
The revised Terms will become effective when posted on the Site unless a different effective date is stated.
Your continued use of the Site after revised Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
22. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.
Any dispute arising from these Terms or your use of the Site shall be handled in the courts having appropriate jurisdiction in Marin County, California, unless applicable law requires another forum.
23. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
24. No Waiver
A failure by Bowman Real Estate Group to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.
25. Entire Agreement
These Terms, together with any policies or agreements expressly incorporated by reference, constitute the agreement between you and Bowman Real Estate Group concerning your use of the Site.
Additional agreements may apply to specific services, transactions, accounts, or real estate brokerage relationships.
